Terms of Service

1. Acceptance of Terms

By accessing or using Spectral ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Spectral is a browser-based photo editing and color grading application. All image processing occurs locally on your device using WebGL 2 and WebAssembly. Spectral does not require an internet connection to function after the initial page load. The Service may be offered as a free version with limited features or as a paid version with additional capabilities.

Spectral is a personal hobby project, developed and maintained by a single developer in their spare time. It is not backed by a company, team, or commercial organization. There are no guarantees regarding the continuity, update frequency, or long-term availability of the Service.

3. Eligibility

You must be at least 13 years of age to use Spectral. If you are under 18, you must have permission from a parent or legal guardian. By using the Service you represent that you meet these requirements.

4. Your Content

You retain full ownership and all rights to any photos, images, and content you import into or create using Spectral. Since all processing happens locally in your browser, we never have access to, nor claim any rights over, your content. You are solely responsible for ensuring you have the necessary rights to any content you edit.

You may use Spectral for personal and commercial photo editing purposes. You may not:

6. Cookbook Recipes & LUT Exports

Editing presets ("Cookbook recipes") and exported .cube LUT files that you create using Spectral are yours. You may freely share, distribute, or sell your own recipes and LUT exports.

7. Intellectual Property

Spectral, including its design, source code, GLSL shaders, user interface, brand assets, and documentation, is the intellectual property of its developer. All rights not expressly granted in these Terms are reserved.

8. Disclaimer of Warranties

Spectral is provided strictly "as is" and "as available". We expressly disclaim all warranties of any kind, express or implied. We do not guarantee that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free. You use the Service entirely at your own risk. Always keep backups of your photos.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including any loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

All your data is stored exclusively in your browser's local storage. The developer has no access to it and cannot be held liable for any loss, corruption, or deletion of data under any circumstances. In jurisdictions where total liability cannot be legally excluded, our maximum aggregate liability to you for any claim is expressly limited to the amount you paid for Spectral Pro, if any.

10. Payment and Refunds

Spectral Pro is a one-time purchase of €20 processed through Mollie, a European payment provider. After payment, a license key is stored in your browser's localStorage. No account registration is required. Pro features are tied to your device; use the Magic Link recovery option to restore access on a new device. Refunds may be requested within 14 days of purchase by contacting us via email.

11. Termination

You may stop using Spectral at any time. Since no account or registration is required, there is no formal termination process. If you wish to remove all application data, clear your browser's storage for this site.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting and will be reflected in the "Last updated" date at the top of this page.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or related to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
